ReSe License Terms and Conditions

Special Conditions Applicable to ATCOR and MODO/MODTRAN®
Licensee acknowledges that it and all registered end users are not a citizen, national, or resident of, and is not under the control of the government of Cuba, Iran, North Korea, Sudan or Syria, and that Licensee will not download or otherwise export or re-export the Software Product and any related technical data directly or indirectly to the above mentioned countries nor to citizens, nationals, or residents of those countries. Licensee will comply with all applicable export, re-export and foreign policy controls and restrictions imposed by the United States and will take the necessary actions and precautions to ensure that it complies with all such laws or regulations.
- None of the registered users is located in and are not a national of Cuba, Iran, North Korea, Syria, or Sudan, and all agree not to transfer the Software Product to any such locations or individuals,
- None of the registered users is listed or affiliated with anyone on any of the following lists:
Denied Persons List - U.S. Department of Commerce, Unverified List - U.S. Department of Commerce, Entity List - Supplement No. 4 to part 744 of the Export Administration Regulations - Specially Designated Nationals - U.S. Treasury, and - I also agree that the licensee and all end users comply with all U.S. and international laws (including the obtaining of any required import license or authorization), and I understand and agree that ReSe Applications LLC is not responsible for my failure to comply with any such laws.
Use of the licenses
The Licensee agrees that the use of licenses may be tracked on ReSe's license server by storage of the startup time and date, the local MAC id, the license identification and user's network domain information.
The software is licensed for use by the Licensee as indicated in the invoice only. Any proliferation, reselling, or rental of the software to 3rd parties requires the written agreement of ReSe with the customer. A license is void if illegitimate 3rd party use is detected by ReSe.
Liability Disclaimer
WITH RESPECT TO THE SOFTWARE, DOCUMENTATION AND MAINTENANCE, ReSe, SSI AND THE U.S. GOVERNMENT SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ReSe EXCLUDES ALL LIABILITY FOR SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE, CONSEQUENTIAL OR ANALOGOUS DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY DAMAGES RESULTING FROM LOSS OF USE, LOSS OF DATA OR LOSS OF PROFITS) ARISING OUT OF OR IN CONNECTION WITH THE PERFORMANCE OF THE SOFTWARE AND THE DOCUMENTATION AND MAINTENANCE PERTAINING THERETO, WHETHER SUCH LIABILITY ARISES UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR STRICT LIABILITY, AND WHETHER ReSe HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
